比较法视野下监狱执法监督员制度探究

摘　　要：监狱执法监督员制度是我国监狱外部监督体系的组成部分,虽然已在我国实践中运行多年,但仍存在执法监督员的人选"民间性"不广、监督员的独立性不强、监督员的巡视培训制度不完善以及缺乏监督报告公开制度等问题。应改革执法监督员的选任制度,建立监督员独立性的保障制度,完善监督员的巡视培训制度,建立巡视报告公开制度。The prison law enforcement supervisor system is the integral part of prison external supervision system in China, although it has been in practice for many years in China, but there exist some problems to deal with, such as the candidates for law enforcement supervisors are not widely used as ＂popularity＂, the independence of supervisor is not strong enough, the inspection training system of supervisor is incomplete, the lack of supervision report disclosure system and so on. We should reform the selection system of law enforcement supervisor, establish the guarantee system for supervisor＇s independence, improve the inspection training system of supervisor, and establish the inspection report disclosure system.
