摘 要:尽管《刑法》第222条增设了虚假广告罪,但实务中真正以虚假广告罪定罪量刑的案例却少之又少,根本原因在于立法中对本罪的构成要件界定较模糊,尤其是何为"情节严重"缺乏统一的认定标准,且对于本罪的法定刑设置不尽合理,处罚力度不大,违法成本低难以达到惩治犯罪的目的,使得本罪形同虚设。因此,文章通过分析虚假广告罪的构成要件力求对本罪有较为系统的认知、通过主客观两方面对何为"虚假广告"进行认定,从而明确了入罪的前提。同时,在"情节严重"的认定标准与刑罚配置等方面提出完善建议。Although "Criminal Law" added the crime of false advertising, there is still very few of crimes of false advertising cases in judicial practice. The root cause is that the elements of the crime of false advertising is vague, especially the lack of standards in "what circumstances could be identified as serious". Besides, the penalties configuration is not reasonable, the punishment is not strong. It is difficult to achieve the purpose of punishing crimes because of the low cost of illegal activities. Through analyzing the elements of the crime of false advertising in details, this paper made a complete picture of it. It identified what was false advertising from both subjective and objective aspects and thus made the premise of incrimination clear. Meanwhile, it proposed the suggestions for identification standard and penalties configuration.
