摘　　要：知识产权诉讼因审理周期长、诉讼成本高等原因,部分权利人顾及经济压力及诉讼风险而被迫放弃。在司法救助、法律援助、政府资助、诉讼保险等作用有限的情况下,引入第三方资助可以缓解知识产权诉讼的接近正义问题。与案件无法律上利害关系的第三方资助无力承担诉讼成本的权利人,从案件诉讼所得中获取收益的同时,还可以为权利人分担诉讼成本、转移诉讼风险,帮助其接近正义,实现权利。Intellectual Property Litigation（IP litigation） can be expensive and risky.Third party funding litigation, which has been seen as one of the most important developments in western civil litigation system, can mitigate the costs and risks involved in pursuing or defending a claim of clients.Third party funding litigation provides financial support to the parties who cannot afford litigation costs for filing a lawsuit or want to transfer lawsuit risks to others. In China, third party funding litigation has the potential to increase the access to justice.
