摘　　要：国使用环境特征是指发明或实用新型专利权利要求中说明作为发明主题的结构之全部或部分需安装于何种其它结构或者需与何种其它结构连接的技术特征。使用环境特征对专利保护范围有限定作用。其侵权判定存在"已经使用""必然使用""可能使用"和"不能使用"等不同标准。其中,"必然使用标准"最为合理。Characteristics of application environment refers to the technical feature in the invention or utility model patent claim that illustrates the structure of invention theme, as a whole or in part,should be installed in what structure, or need to be connected with what structure. Characteristics of application environment limits the scope of protection of the patent right. There are different infringement judgment standards concerning characteristics of application environment, such as in-use standard, inevitable use standard, possible use standard, impossible use standard, among which inevitable use standard is most reasonable.
