摘　　要：本文概述了当前我国审理知识产权案件的三个层级法院,分别针对一件"防盗门锁"外观设计专利行政纠纷案作出的两审判决以及一个裁定的核心内容。文章进一步结合外观设计法的立法目的、宗旨及保护客体,提炼出判定功能性设计对产品外观设计整体视觉效果影响的标准,有助于在外观设计专利的确权审查和侵权判定实践中,准确把握和考量功能性设计对产品外观设计整体视觉效果的影响。This paper summarizes the three-level trial of the patent administration dispute on ＂Security door lock＂ design, including the core content of the judgments made by Beijing Intellectual Property Court and Beijing High People＇s Court respectively, and a ruling made by Supreme People＇s Court. This article also abstracts the examination standard of the influence of functional design on the overall visual effect of a product in the light of legislative purpose and the object protected by the Design Patent Law. It has great guidance value for us to understand and grasp the examination standard of the influence of functional design on the overall visual effect of a product in review of the patent right and infringement of a design patent.
