摘　　要：闲置土地是一个具有确定含义的法律概念。我国目前面临着农村大量宅基地的闲置、城郊旧居改造中的土地闲置、"城中村"改造中的土地闲置、国家建设中的土地闲置和政府土地储备中的土地闲置等五大问题。要全面正确地理解闲置土地处置的新规定,在处置实践中规范闲置土地的处置举措。为保护权利人的权益而完善闲置土地处置程序,为遏制恶意囤积土地设立闲置土地处置要件,为合理开发利用土地规范闲置土地收回方式。要在平稳推进中提升闲置土地的处置效能,积极探索闲置土地处置的有效途径,严格规范闲置土地的行政处罚行为,依法提高闲置土地处置的法律位阶。Idle land is a clearly defined legal concept. China is facing five major problems regarding idle land,including rural residential idle land,suburban idle land of old buildings renovation,idle land of renovating village in city,idle land in national constructing,and idle land of government ＇ s land reservation. It is needed to comprehensively and correctly understand the new regulations of idle land management,and to standardize the management measures of idle land in practice.In order to protect the rights and interests of the obligee,it is necessary to improve procedures in managing the idle land. To control deliberate hoarding land,it is needed to set special case for idle land management. To achieve rational development and utilization of idle land,we should normaize the ways to reclaim idle land. The author put forward that management effect of idle land should be promoted smoothly, effective ways to manage idle land should be explored actively,administrative sanction of idle land should be normalized strictly and legal status of idle land management should be improued according to law.
