论我国商业银行综合化经营监管法律制度的完善

摘　　要：近年来,我国商业银行综合化经营迅猛发展,风险积聚,党中央和国务院高度重视,要求加强监管,守住不发生系统性风险。因此,对商业银行综合化经营的监管是时代的必然产物,也是我国监管部门当前的一项重要课题。从分析我国商业银行综合化经营的主要模式和分业监管下的主要监管方式切入,对监管的有效性提出质疑,深入剖析了当前被监管行为和监管举措之间的错配,并针对性提出了"疏"、"堵"结合辩证对待,引入功能监管统一监管标准、加强制度供给,发挥金融稳定发展委员会职能加强监管机构协调,修订监管法规填补监管空白,完善商业银行综合化经营监管法律体系的完善方案,切实加强监管,防范风险。In recent years,the comprehensive management of commercial banks in China has developed rapidly and risks have accumulated. The Party Central Committee and the State Council attach great importance to it and require that supervision be strengthened and that systematic risks should not occur. Therefore,the supervision of the integrated management of commercial banks is an inevitable outcome of the era,and it is also an important topic of the current regulatory authorities in China.This paper cuts in from the analysis of the main modes of comprehensive operation of commercial banks in China and the main supervision methods under the supervision of separate industries,questions the effectiveness of supervision,and thoroughly analyzes the mismatch between the current regulated behaviors and regulatory measures,and put forward the combination of dialectical treatment,of ＂sparse＂and＂blocking＂,introduction of functional supervision and unified supervision standards,strengthen the institutional supply,exploiting the functions of the Financial Stability Development Committee, strengthening the coordination of regulatory agencies,revising regulatory regulations to fill regulatory gaps, and improving the comprehensive management supervision system of commercial banks,strengthening supervision and preventing risks.
