摘 要:当前,毕业生保底签约、肆意违约、维权困难等问题屡见不鲜,与之相对的用人单位预收《普通高等学校毕业生就业协议书》、押金,规定"霸王条款"等就业侵权事件更时有发生。无论是毕业生违约还是用人单位就业侵权事件的出现,都是种种主客观因素共同作用的结果。文章认为加强对学生的就业法律教育和政策指导,培养高校毕业生就业法治观念和契约意识,有利于营造良好、有序的就业环境,降低上述问题发生之可能。At present, it is not uncommon that college graduates sign minimum guarantee contracts, break con-tracts wantonly and feel hard to protect their own rights. And it occurs time to time that employers infringe uponthe rights of college graduates by signing unreasonable employment agreements, charging them deposit in ad-vance, and so on. There are various factors both subjective and objective ones resulting in the problems men-tioned above. This article points out that it is necessary to reduce the probability of problems above by strengthen-ing legal education and policy guidance on the employment of college graduates, fostering their concept of rule oflaw and contract consciousness so as to create an orderly employment environment.
