摘 要:如何发展中国的聘任制公务员制度,德国公职法中的有期限公务员可能成为借鉴对象。有期限公务员是在绩效原则的推动下,适度改造终身制公务员而形成的一种公务员类型。其在任职上有具体期限,通常适用公务员法律关系的规定,在类型上遵从法律保留原则。由于德国基本法中"公关员制度的传统原则"的规定,联邦宪法法院在裁判时经常在绩效原则和终身制原则之间权衡,这为深入认识绩效原则提供了可能。为此,结合中国公务员聘任制改革法律文件和实践中的问题,提出了法律完善的思路。How to develop China's civil servant appointment system? The temporary Civil Servant according to German Public Service Law becomes a reference object.It is a civil servant who moderately transforms tenure civil servants under the impetus of performance principle.It has a specific period of time in the service, which is applicable to the provisions of legal relationship of the civil servant,and its types must compliance with the principle of legal retention. Because of the traditional principles of the public relations system in German Basic Law, the Federal Constitutional Court often weighs between performance principle and tenure principle, which provides the possibility of in-depth understanding of the principle of performance. To this end, combined with legal documents and practical problems of Chinese civil servant appointment system reform, we put forward some legal proposals.
