摘 要:人大监督是自然资源国家所有权的内在要求和制度构成,是实现自然资源国家所有权价值的重要保障。然而,由于受理论研究、立法观念等方面的限制,目前自然资源国家所有权行使人大监督的立法还存在不明确、缺乏针对性和可执行性等问题,最终导致人大无法对政府行使自然资源国家所有权进行有效监督。人大监督不力的自然资源国家所有权本身是不完整的,容易成为政府独占、挥霍国有自然资源的正当性面具。应在充分体认人大监督对于实现自然资源国家所有权具有重要意义的基础上,有针对性地对自然资源国家所有权行使的人大监督进行专门立法,并从设立监督机构、明确监督权行使的形式、确定监督重点、完善监督程序等方面具体展开。Supervision by the National People's Congress (NPC) is the inherent requirement and institutional structure of the national ownership of natural resources. However, the legislation on the exercise of national ownership of natural resources by NPC is still unclear, less targeted and low feasible at present, which results in the inability of NPC to supervise effectively over the exercise of the state ownership of natural resources by the government ultimately. The supervision by NPC is great significant for the realization of the national ownership of natural resources, we should legislate specifically on the supervision of NPC over the exercise of state ownership of natural resources, and the specific measures should made from establishing supervisory body, clearing the form of exercise of supervisory power, setting oversight priorities, improving the supervision procedures and other aspects.
