生态文明制度的冲突与整合

摘　　要：生态文明制度分为正式制度和非正式制度,包含法律规范、软法规范、文化规范和习俗规范等四种基本规范。生态文明的正式制度内部及与非正式制度之间都存在一定冲突,影响了我国当前重点加强建设的生态文明法律规范和官方制定的软法规范的权威和认同,给生态文明法治化带来了一定危害,因而有必要对各类规范整合。生态文明制度的规范整合,应当坚持"一元多样"原则,从文化规范、习俗规范、软法规范和法律规范四个层面着手。文化规范要在生态文明建设中融合与创新,习俗规范要进行现代价值的梳理与选择,软法规范要规范化和系统化,法律规范要通过"自上而下"和"自下而上"的双向互动与其他规范整合。The institutions of ecological civilization, including the formal institutions and the informal institu- tions, are composed of four fundamental norms named legal norms, soft law norms, cultural norms and pratical norms, which conflict in some extent between and among them. These conflicts would impair the authority and accept- ance of the legal norms, the soft law norms made by the government, and even the ecological rule-of-law. So it is necessary to integrate the conflicting norms. The ways of integration include the following aspects ： to integrate and in- novate the cultural norms in the construction of ecological civilization, to analyse the modern values of pratical norms and choose them, to standardize and systematize the soft law norms, to integrate the legal norms and other norms through the two-way interactive methods of top-down and bottom-up.
