南极海域外大陆架划界争端法律问题研究

摘　　要：人类对南极大陆的探索与争夺已持续两个多世纪,在南极问题上各国经妥协和合作形成了"南极条约体系"。《南极条约》并不排斥其他国际公约在南极海域的适用,而相关国家利用1982年制定的《联合国海洋法公约》与《南极条约》之间的矛盾与冲突,对大陆架等区域的规定提出了划界要求。本文通过分析南极海域外大陆架划界争端的历史原因、法律体系以及内容冲突,认为外大陆架划界面临法律障碍和委员会障碍,虽然南极地区外海域主权要求与"南极条约体系"在主权上冲突,但与资源开发勘探兼容。中国应一方面积极参与南极相关条约的协商和制定,另一方面应加强和相关国家的合作与交流。For more than two centuries, the mankind has continued to explore and compete for the Antarctic. The Antarctic Treaty was formed by the compromise and cooperation of many countries. The Antarctic Treaty does not exclude the application of other international conventions in the Antarctic waters. Conflicts between The Antarctic Treaty and The United Nations Convention on the law of the sea in the application of Antarctic waters.The relevant countries have demarcation requirements for the provisions of the continental shelf and other regions. This paper analyzes the historical reasons, legal system and content conflicts of the delimitation of continental shelf outside Antarctica. It is considered that the demarcation of the outer continental shelf is faced with legal obstacles and committee obstacles. Although the sovereignty over the requirements of the Antarctic waters conflicts with The Antarctic Treaty System and UNCOL, it is compatible with the exploration and exploration of resources. China should actively participate in the negotiation and formulation of Antarctic related treaties on the one hand. On the other hand, cooperation and exchanges with relevant countries should be strengthened.
