线人拒证特权的比较法研究

摘　　要：线人作为给侦查机关提供侦查线索或者情报信息的人,在刑事诉讼过程中是否享有拒证特权,享有何种拒证特权,各国立法有不同规定,司法实践中有不同做法。在全面厘清线人和拒证特权概念的基础上,文章全面阐述了拒证特权的保护对象,线人是否享有拒证特权,线人享有何种拒证特权等问题;最后,探讨了我国立法对拒证特权的规定和司法实践中的做法,并对我国线人的拒证特权问题进行了深入分析。As for the informant as a person who provides clues or information to the criminal investigation agency in the process of criminal prosecution whether enjoy the privileges of refusal and what kind of the privileges of refusal,there are different regulations among different countries and different approaches in judicial practices. On the basis of comprehensively clarifying the concepts between the informant and the privilege of refusal,this paper illustrates the protected object to the privilege of refusal,whether the informant enjoys the privilege of refusing and what kind of the privilege of refusal the informant has,and so on. Finally,it probed the regulations on the privilege of refusal in legislation and the practices in judicial practice in our country,as well as analyzed the issue of the privilege of refusing the informant in our country thoroughly.
