摘　　要：警察公务用枪受困于维持社会稳定现实需要的冲动和防止警务用枪不当使用侵犯公民合法权益的控制之间的矛盾。控制策略在我国现行涉枪法律制度中脉络清晰,冲动来源于以暴恐犯罪为主因引发的对枪支使用的呼唤。建立以自由优先为原则,以自由和安全的平衡为补充的枪支管理法律制度的价值取向是解决困局的基本选择。The police＇s guns are trapped in the contradiction between the practical need for social stability and the prevention of the illegal use of guns,which infringes the citizens ＇ legitimate rights and interests. The control strategy has a clear skeleton in current legal system involving the gun,and the impulse comes from the calls to the guns use caused by the violent terror criminal as the main reason. The fundamental choice of solving the predicament is to establish the value orientation on the legal system of gun management,which gives the priority to freedom and balances the relationship between freedom and security.
