摘　　要：约束行政自由裁量权,保证其公正行使是行政法治的核心议题之一。行政自由裁量权的滥用将会造成对行政相对人合法权利的直接损害。本文认为,实现行政自由裁量权的公正行使主要依靠的是行政人的伦理自觉。为了使行政人在面临自由裁量权时能够主动听从伦理的召唤,国家需要为行政相对人提供系统的伦理道德知识、为行政相对人提供伦理技能训练、成立专门的行政人伦理组织、实行伦理奖励、追究伦理责任。To restrain administrative discretion and ensure its equitable implementation is one of the core issues of administrative rule of law.To reach this goal, the main practice at present is to make many rules.However,the abuse of the administrative discretion is still a disturbing problem.We believe that the impartial implementation of the administrative discretion depends mainly on the administrators＇ ethical consciousness.In order to make the administrators to follow the calls of the ethics when applying the administrative discretion,the state should provide them with the ethical knowledge and training;establish specialized ethics organization,and practice reward and accountability of ethics.
