设区的市行政立法不作为法律责任探析

摘　　要：法治国家的构建首先要有权责一致的法律体系支撑,但对于设区的市行政立法权有权无责的规定不符合法治国家的建设要求。因此,本文通过对设区的市行政立法权及其立法不作为的范围予以界定,阐述行政立法不作为的表现形式和可能导致的危害后果,同时厘清行政立法不作为的发现途径,以期促进设区的市合法谨慎地行使立法权。The municipal government authorized by the legislative law can make its own legislation within the limits of authority,but it does not stipulate the corresponding legal liability of the authority.The construction of a country under the rule of law must first be supported by a consistent legal system with responsibilities and responsibilities.The provisions of the right to be accountable for the administrative legislative power of a district do not conform to the requirements of the construction of a country under the rule of law.The scope of the omission of the legislative power and the administrative districts of the city are defined,elaborated the administrative legislation omission form and may lead to harmful consequences,and to clarify that the administrative legislation omission way and to investigate the corresponding accountability system in the legal level of negligence act of legislation to be adjusted,in order to promote districts the municipal government legal cautious exercise of legislative power.
