摘　　要：本文通过"软法"的视角,对大学章程性质"契约说"与"自治说"这两种理论的分析,明晰了大学章程的自治性质,从"软法"的特征证明了大学章程的自治功能,提出了在"软法"机制下大学章程的制定应当保障充分的民主与协商精神。From the perspective of ＂soft law＂, this article analyzes the two theories of ＂the theory of contract＂ and ＂the theory of self-government＂ in the nature of the university＇s constitution, which clarifies the autonomy of university regulations and proves the autonomy of university regulations from the characteristics of ＂soft law＂. The function proposed that the formulation of university regulations under the ＂soft law＂ mechanism should guarantee the spirit of full democracy and consultation.
