党支持和保证人大依法履职的方式和途径

摘　　要：党支持和保证人大依法行使国家权力,是实行党的领导、人民当家作主和依法治国统一的基本途径和宪制安排,支持和保证人大依法履职具有客观必然性和现实必要性。党支持和保证人大依法行使各项职权是实现党的全面领导,保障人大的宪法地位和推进依法治国、依法执政的根本方式。根据现行党内法规的规定,党支持和保证人大依法履职的方式和途径主要表现在:在人大行使立法权的立法规划和计划批准、法律起草决定或者批准、法律议案审议以及法律议案通过等环节给予支持和保证;在人大行使监督权时支持人大进行立法监督和完善执法监督以及对一府一委两院的监督;在人大行使重大事项决定权方面,建立对人大行使决定权的保障机制和监督机制;在人大行使选举任免权方面,处理好党管干部原则与人大选举任免权的关系、支持人大完善选举任免权程序等。积极探索完善人大依法充分有效地行使各项职权的方式和途径,破解现实中影响人大依法行使立法权、监督权、重大事项决定权和选举任免权体制机制障碍,有利于充分发挥人大作为人民代表机关和国家权力机关的作用,有利于保障作为我国基本政治制度的人民代表大会制度的有效运行。The Chinese Communist Party support and guarantee that the National People＇s Congress（NPC）perform national power according to law.This is the basic approach and constitutional arrangement to ensure the leadership of the Chinese Communist Party,the strategy of people being the master of the country,and the ruling of the country by law.To support and guarantee the NPC to perform its duty is a necessity based on reality in China.It is a fundamental way to realize the Party＇s overall leadership and to assure the NPC constitutional position as well as to promote law-based exercise of state power.According to the current Party laws and regulations,the approaches to support and guarantee that the NPC perform national power by law are reflected in stages such as legislative programming and project approval,law drafting assessment or approval,legislative proposal deliberation and approval when performing its right of making law;supervision on legislation,law enforcement,and the people＇s government,supervisory committee,people＇s court and the people＇s procuratorate when performing its right of supervision;establishing the safeguard and supervision mechanism when performing its decision right on significant events;properly handling the relationship between principle of the Party assuming the responsibility for cardres＇ affairs and power of appointment and removal,as well as supporting the NPC to improve the procedure when performing the right of election,appointment and removal.To explore the ways and approaches for the NPC to perform its duty effectively and sufficiently according to law,and sweep away the systematic barriers that hinder the NPC from performing its right of legislation,supervision,decision on big issues,election,appointment and removal,will help the NPC to play its due role as the people＇s representative organization and country＇s power institution,and guarantee the effective operation of people＇s representative system as the basic political system.
