摘 要:我国农村宅基地所有权主体多元、边界不清,收益权不完整、外延狭小,流转权受限、价值缩水,主要原因是相关法律规范内容疏漏、运行失调及监督机制失灵。为了更有效地实现农村宅基地财产权,应在坚持集体土地公有制性质不变的前提下探索以共享富民为价值导向的法治创新,树立分红让利的法律观念,以涨价共享思路对农村宅基地赋权扩能,使农民可以依法选择出租、抵押、担保、转让等宅基地财产权实现路径,严格实施法律制度以定分止争,保障农民在改革开放中有更多获得感,促进农民增收、农村稳定、农业发展。Many problems have been exposed in China’s rural homestead,such as the complex ownership structure,unclear rights boundaries,incomplete income rights,narrow extension,restricted circulation rights and shrinking value. The main reason is the negligence of the relevant legal norms,the maladjustment of the operation and the failure of the supervision mechanism. To realize the rural homestead property rights more effectively,it is necessary to explore the innovation of the rule of law based on value oriented sharing and enriching the people under the premise of adhering to the nature of public ownership of collective land consistently,which requires establishing a legal concept of distributing dividends and surrendering part of the profits. Consequently,rural homestead will be empowered with rights and expanded rights ability following the idea that sharing value increase allows farmers to have an opportunity to choose the way to realize the homestead property rights,such as rent,mortgage,guarantee and transfer. Meanwhile,the whole society should strictly implement the legal system to ensure that the farmers have more sense of gain in the reform and opening up,and promote farmers’ income,rural stability and agricultural development.
