摘　　要：电子警察是由交通管理部门设置,代表交通管理部门、代替交通警察记录、固定交通违法行为证据的拟制人。它是依赖技术来锁定危险驾驶行为的社会风险管理措施。它缓解了警员不足的压力,减少司机违章超速行驶行为,提高了执法的效率。电子警察的设置,牵扯到对人民基本权利之干涉,必须法律明确授权始得为之。而采列国之成规,装设电子警察要符合法律保留原则,而予有限度的授权,并要求遵守一定的法律程序。要么采用以国家之法律,来规定其规范目的、基本原则、适用除外等事项;要么委由各地方自治团体的条例来规定。而当下我们对装设电子警察的法律尚付阙如,电子警察的设置概括委托授权予交通管理部门,可能造成行政权力独大,对人民权利造成侵害,所以宜尽速立法,落实依法治国的国家治理理念。The e-police is a fictional person who is installed by the traffic management department, replaces the traffic police to record, and fix the evidence of traffic violations. It is a social risk management measure that relies on technology to techno-fixes dangerous behaviors. It free local policeto do more important works, force drivers to be more speed conscious and induce them to obey speed limits. The consistency of reported reductions in speed and crash outcomes across all studies show that speed cameras are a worthwhile intervention for reducing the number of road traffic injuries and deaths. The installing of electronic police involves the interference of people＇s basic rights and must be clearly authorized by law. It must comply with the principle of legal reservation, and obey certain legal procedures. At present, Automated Speed Monitoring Law is still wantingwhich may result in an arrogant administrative power and infringement of people＇s rights. Therefore, we should legislate as soon as possible to implement the rule of law.
