摘 要:污染环境罪是否具备行政从属性存在很大争议,该命题关系到环境行政权与环境司法权的界域与衔接问题,我国《刑法》第338条"违反国家规定"之描述无法得出污染环境罪的行政从属性;实践中环境行政执法与环境刑事司法的衔接不良产生对污染环境罪的行政从属性的质疑;污染环境罪由行政犯向刑事犯的转化趋势否定了污染环境罪的行政从属性。"刑法对污染环境行为的提前规制"乃是现行环境刑事立法的本来面貌,并未违反罪刑法定原则和刑法谦抑性的要求,其突破口为对污染环境罪行政从属性的否定。Whether the crime of environmental pollution is subject to administrative law is quite controversial. This is related to the boundaries and connection between the environmental administrative power and environment judicial power. We cannot draw the conclusion that the crime of environment pollution is subject to administrative law from the expression of "violation of state regulations" in Article 338 of Criminal Code. In practice, the poor connection between environmental administrative law enforcement and criminal justice imposes doubts upon the nature of being subject to administrative law for the crime of environmental pollution. The trend of transforming the crime of environmental pollution from the administrative crime to the criminal offence negates its nature of being subject to administrative law. " The advance regulation of the crime of environmental pollution behavior by criminal law" is the original shape of the current criminal legislation on environment, without violation of the principle of legality and the requirement of modest and refraining nature of criminal law, and its breakthrough is the negation of the nature of being subject to administrative law for the crime of environmental pollution.
