摘　　要：当下,中国刑法学向何处去的问题并未彻底解决,结合中国法学流派发展的大背景,探讨中国刑法的发展方向问题因而极有必要。当下中国虽然没有形成法学流派,但中国法学者对建立法学流派的志趣异常明显,并已初步形成政法法学、教义法学和社科法学三种学派。作为部门法的刑法,学派之争虽然启动甚早但远未尘埃落定。刑法教义学并未得到中国刑法学者的一致认同,政法法学生命力强大,社科法学的兴盛也要求更进一步思考刑法学的方向问题。根据政法法学与社科法学的各自特点,以及刑法学科的自身属性,在政法法学与教义法学之间,中国刑法应选择(刑)法教义学;在教义法学与社科法学之间,中国刑法应选择(刑)法教义学。At present, the issue where the Science of Criminal Law of China should and will go has not been completely resolved. Against the background of the development of schools of law in China, it is essential to discuss the development trend of Chinese criminal law. Although schools of law has not been formed in current China, Chinese legal scholars has obvious inclination to establish schools of law and three schools of thoughts, i. e. the Science of Political Law, the Science of Dogmatized Law, the Social Science of Law have been preliminarily formed. Regarding the criminal law as a body of law, the competition between schools of thoughts started very early, but it is far from settlement. In the field of criminal law, the dogmatized law has not been unanimously accepted by Chinese criminal law scholars, the science of political law has strong vitality and the prosperity of the social science of law requires further deliberation of the direction of the criminal law. According to respective characteristics of the science of political law and the social science of law, as well as the nature of the discipline of criminal law, China shall choose the science of dogmatized law for the criminal law between the science of political law and the science of dogmatized law;and China shall also choose the science of dogmatized law for the criminal law between the social science of law and the science of dogmatized law.
