摘　　要：受制于转型期中国经济社会制度的未定型、未定局,局限于城乡三项医保制度渐进性从"分割"到"整合和统一"的过渡型、未定性,中国初级阶段的基本医保立法存在理念缺乏、结构残缺、规范粗略、体系碎片化、法律功能不良等问题。进入新时代,党的十九大创立了习近平中国特色社会主义思想和理念,确立了基本医保制度建设的目标,为推进基本医保立法发展明确了方向,创造了可行的制度环境与机遇。新时代基本医保立法应当遵循"保障国民医保权利"的理念和宗旨,围绕参保和保险费筹集、医保基金管理与经办、医保待遇支付等核心制度环节,构建国民基本医保权利体系,并同步完善基本医保的行政管理和经办实施机制,全面定型和统一城乡基本医保制度。Subject to the undefined and undecided state of China＇s economic and social system during the transitional period and limit to the transitional and indeterminacy state of urban and rural areas＇ three medical insurance systems＇ gradually nature from ＂fragmentation＂to ＂integration and unification＂,the basic medical insurance legislation of China＇s initial stage have many problems,which include the lacked concept,incomplete structure,rough specification,fragmented system,and poor legal functions. In the new era,the 19 th CPC National Congress established Xi Jinping＇s socialist ideas and concepts with Chinese characteristics,established the goal of building a basic medical insurance system,set a clear direction for promoting the basic medical insurance legislation development,and created a viable institutional environment and opportunities. The new era of basic medical insurance legislation should follow the concept and purpose of＂guaranteeing the rights of the national medical insurance＂,and build a national basic medical insurance rights system based on the core institutional links such as participation in insurance and insurance fund collection,management and handle of medical insurance funds,and medical treatment payment and simultaneously improve the basic medical insurance administrative management and handling implementation mechanism,to comprehensively shape and unify urban and rural basic medical insurance system.
