摘　　要：由于铁路运单不具有物权属性,银行对以铁路运单作为信用证结算方式的随附单据接受度低。随着中欧班列的快速发展,市场主体对铁路运单质押融资的需求日益升温。从归纳提单现有国际公约与国内法律规定入手,分析了提单物权凭证功能的作用,讨论了签发具有物权凭证属性提单的必要性和可行性,提出了相关建议。Since the rail waybill does not have the property of property, the bank has low acceptance of the attached documents as the settlement way of the letter of credit by the railway waybill. With the rapid development of China and Europe, the demand for the financing of railway transportation is increasing. Starting from the summary of existing international conventions and domestic laws and regulations, this paper analyzes the function of documentary evidence of bill of lading, discusses the necessity and feasibility of issuing documentary bill of lading with property rights, and puts forward relevant suggestions.
