军民融合发展立法基本原则的逻辑展开

摘　　要：当前,学界缺乏对军民融合发展立法基本原则应有的关注度。根据习近平总书记讲话精神提炼的"统融新深"所展开的"统筹协调"、"融合共享"、"全面创新"、"深度融合"四个基本原则,发挥着行为指引功能。"统筹协调、融合共享"两个原则彰显着共时性、以点带面、有限性的特质,而"全面创新、深度融合"两个原则呈现出历时性、以面带点、无限性的特质。四个基本原则中,全面创新原则是核心重点;统筹协调原则是全面创新原则的组织保障;融合共享原则是全面创新原则的逻辑前提;深度融合原则是全面创新原则的目的效果。军民融合发展立法四个基本原则的精神和灵魂是在变中求不变,在不变中求变,以不变应万变,以万变应不变,体现了稳定性与变动性的辩证关系。At present, the academic circles lack the attention it deserves to the basic principles of legislation for military-civilian integration development. The four basic principles of ＂integrated coordination＂, ＂integration and cosharing＂, ＂comprehensive innovation＂, and ＂deep integration＂ have played a guiding role in practice, which are abstracted and developed from the spirit of General Secretary Xi Jinping＇s relevant speech. The two principles of ＂integrated coordination＂ and ＂integration and co-sharing＂ highlight the qualities of synchronicity, fanning out from point to area, and finiteness, while the two principles of ＂comprehensive innovation＂ and ＂deep integration＂ present the characteristics of diachronism, comprehensiveness and infiniteness. Among the four basic principles, the principle of ＂comprehensive innovation＂ is the core focus. The principle of ＂integrated coordination＂ is the organizational guarantee of the principle of ＂comprehensive innovation＂. The principle of ＂integration and co-sharing＂ is the logical prerequisite for the principle of ＂comprehensive innovation＂. The principle of ＂deep integration＂ is the goal and effect of the principle of ＂comprehensive innovation＂. The spirit and soul of the four basic principles of legislation for military-civilian integration development reflects the dialectical relationship of stability and variability.
