摘 要:经过两岸各方的不懈努力,两岸司法互助在过去30年尤其是马英九主政8年期间取得了长足进展。在制度建设方面,两岸通过签署司法互助协议、进行单边立法,使得两岸司法互助从个案处理步入了制度化合作。在实务运作方面,两岸司法互助与合作呈现出案件数量多、合作范围广、民众认可度高的基本特点。但是,随着2016年民进党重新上台执政,拒不承认体现一个中国原则的"九二共识",两岸合作的政治基础和基本互信不复存在,两岸司法互助陷入停滞,一些急需突破的领域已无法继续推动。未来两岸间司法合作与交流的顺利开展,必须仰赖两岸合作政治基础的恢复和两岸互信的重建。Thanks to the unremitting efforts of all parties on both sides of the Taiwan straits, judicial assistance has made great progress in the past 30 years, especially in the eight years of Ma Ying-jeou's administration.In terms of system construction, the two sides have entered into institutionalized cooperation through signing judicial mutual agreement and unilateral legislation. In terms of practical operation, the mutual judicial assistance between the two sides presents the basic characteristics of large quantities of cases, wide range of the scope of cooperation and the high degree of public recognition. However, with the political change and the democratic progressive party coming to power in 2016, the cross-strait judicial assistance faces many obstacles and uncertainties due to the loss of the political foundation and basic mutual trust. Some areas that are badly in need of breakthrough cannot be pushed forward. The smooth development of judicial cooperation between the two sides in the future must rely on the reconstruction of the political foundation of cross-strait cooperation and the reconstruction of mutual trust.
