论我国绿色保险法律制度的完善

摘　　要：绿色保险是藉由保险之风险管理工具,填补环境污染和气候变化所造成的损失,降低经济活动可能产生的环境风险,实现可持续发展的一种经济机制。长期以来,我国把绿色保险狭隘地理解为环境污染责任险,且相关研究囿于单一的具体规则。其实,绿色保险法律制度是由各个要素构成的一项整体性制度,虽然目前我国绿色保险实施的相关制度均已建立,但各个要素间散乱无序、互不协调,导致实践中"叫好不叫座"。为化解这一困局,需要汲取创新、共享等先进发展理念,使其内化到行为主体的策略性选择中;要增加绿色保险的硬法和软法供给,实现二者的双向互动;要对绿色保险实施主体建立持续的激励机制,重塑经济活动的成本和价格。通过对构成绿色保险法律制度的各个要素进行改进和优化,能够促进绿色保险法律制度的自我实施。Green insurance is an economic mechanism. Because insurance can be used as a risk management tool,green insurance can make up for the loss caused by environmental pollution and climate change,reduce the environmental risks that may arise from economic activities,and achieve sustainable development. For a long time,China has interpreted green insurance narrowly as environmental pollution liability insurance,and related research has been limited to a single specific rule. In fact,the green insurance legal system is an overall system composed of various elements. Although the relevant systems for the implementation of green insurance in China have all been established,the various elements are disorderly and uncoordinated,resulting in the practice of＂best game,no one played＂. In order to resolve this predicament,firstly,it is necessary to absorb advanced development concepts such as innovation and sharing so that it can be internalized into strategic choices of behavioral agent. Secondly,it is essential to increase the supply of hard and soft law for green insurance and achieve twoway interaction. Thirdly,it is vital to establish a sustainable incentive mechanism for the main body of the implementation of green insurance and reshape the cost and price of economic activities. Through the improvement and optimization of the various elements that constitute the green insurance legal system,self-enforcement of the green insurance legal system can be promoted.
