摘　　要：通过对自然资源利用权利类型的反思,可以论证自然资源产品取得权作为独立的自然资源利用权利类型的正当性。自然资源产品取得权的创设是自然资源所有权权能分离的结果,自然资源行政许可的功能应当限定为解除自然资源开发利用的一般禁止。自然资源产品取得权的核心权能是分离和取得权能,系自然资源所有权使用和收益权能的转化形态。自然资源产品取得权的占有权能具有特殊性,更多表现为对自然资源观念上的抽象占有。对自然资源所依附的载体性资源的占有是独立存在并辅助自然资源产品取得权行使的资源载体使用权的权能。基于自然资源生态价值和社会价值保护的需要,自然资源产品取得权的行使应当遵守限度条件,这些限度条件划定了自然资源产品取得权的权利边界,并通过公法管制措施得以明确化和具体化。After reviewing the typification of the right to utilizing natural resources,we can find the justification of the right to acquiring natural resource products（hereinafter referred to as acquisition right）as one independent right type.The creation of the acquisition right is the result of the separation of ownership of natural resources.The function of administrative license for natural resources should be limited to removing the general prohibition on the exploitation and utilization of natural resources.The core capacity of the acquisition right is to exploit natural resources and acquire the natural resource products,which are the transformation form of the capacity of use and profit in the ownership of natural resources.The possession capacity of the acquisition right is special,which is the conceptual possession rather than the actually possession on natural resources.The possession of the land,water,or sea,containing other natural resources,is the rights independent of acquisition right,and serve the exercising of acquisition right.For the purpose of the protection of the ecological and social value,the exercise of acquisition right shall comply with the limit conditions.These limit conditions can define the boundary of acquisition right,and can be determined and crystallized through the regulations in public law on natural resources.
