摘 要:区域水权的诞生反映出水资源危机背景下,中央政府与地方政府间的"集权—分权"关系。基于一种"委托方—管理方—代理方"的科层关系结构,县域范围内的水权制度实践呈现出科层权力运作的特点。作为区域水权的管理方,地方政府通过水权转换将区域水资源在工业与农业间进行再分配,并将剩余农业水权的管理委托给地方水务部门代理执行。区域水权的运作不仅存在多重"委托—代理"关系造成的地方政府"过度集权"问题,也存在地方水务部门的"自己人代理"困境。区域水权制度改革应进一步明晰地方政府与地方水务部门间的权责边界和产权归属,并重视农户的用水权益。The birth of regional water rights reflects the "centralized-decentralized"relationship between the central government and local governments in the context of water crisis.Based on a kind of"principal-management-agent"of the bureaucratic structure,the practice of water rights within the county scope presents the characteristics of bureaucratic power operation.Local governments as the management of regional water rights,redistributed regional water rights between industry and agriculturethrough the transfer of water rights,and let thelocal water department manage regional irrigation water rights.The operation of regional water rights not only has the problem of local government's "excessive centralization",but also has the local water department's"self-agent"dilemma.The following regional water rights system reform should further clarify the power and responsibility boundary and the ownership of property rights between local government and local water departments,meanwhile,pay attention to the rights and interests of the farmers.
