摘　　要：基于深海矿业之特殊性,审视国内当前深海装备融资租赁法律关系中深海装备出租人主体数量不足,股权质押合同内容缺乏高效监管,以及租赁物深海装备使用价值浪费这三方面困境;以反塑造的学理视角提出破解困境的法律制度构建,在《深海海底区域资源勘探开发法实施细则》中补充对出租人技术引进的激励制度,加入合同内容识别的监督检查制度,以及建立装备高效利用的保留租约制度。以期引导我国深海装备融资租赁实务有序开展。Based on the uniqueness of deep-sea mining, this paper studies the three problems in the legal relations of the law on the financing lease of the deep-sea equipment： the insufficient quantity of the lessor of the deep-sea equipment, lack of efficient supervision on the content of equity pledge contractandthe waste of leasehold deep-sea equipment＇s use value. It builds a legal system to solve the problems from the perspective of anti-molding theory, including the implementation of resource exploration and development law in deep seabed area, supplementing the incentive system for lessor＇s technology introduction and the supervision and inspection system of contract content identification, and establishing a retention tenancy system for efficient utilization of equipment so as to guide the development of China＇s deep-sea equipment financing lease in order.
