摘　　要：司法监察是中国古代监察制度的重要内容,由于司法关乎国计民生,直接影响社会秩序乃至国家的稳定,因此在历代备受重视。法律法规不仅是司法审判活动的依律,也是司法监察的重要依据,司法监察专向性突出,直接指向与司法活动有关的官吏的渎职违法,与司法审判活动相结合,通过御史参与某些重大疑难案件的审理和定期或不定期的出巡、录囚来实现。司法监察是对司法权力的监督,是为了保证司法权力公正合理地使用,遏制权力的滥用和腐败。因此,借鉴古代的司法监察在监察体制改革的当下是合适的,也是必要的。Judicial supervision is an important content of China＇s ancient supervision system. Because the judicial matter is about the national economy and the people＇s livelihood,directly affects the social order and the stability of the country,therefore judicial supervision has been attached importance in the past dynasties.Laws and regulations are not only the law of judicial proceedings,but also an important basis for judicial supervision. Judicial supervision is prominent,which directly points to the malfeasance of officials related to judicial activities. The judicial supervision and judicial activities are combined to carry out the trial of certain major difficult cases through censors and regular or irregular tours and prison-checking system. Judicial supervision is the supervision of judicial power,which is to ensure the fair and reasonable use of judicial power,to curb the abuse and corruption of power. Therefore,it is appropriate and necessary to use the ancient judicial supervision to monitor the reform of the system nowadays.
