摘　　要："方法界定产品"权利要求是一类特殊的产品权利要求。在专利审查过程中,美国、日本和我国采用"物同一说"确定其保护范围。但在侵权诉讼过程中,最终美国选择了"方法限定说",日本选择了"物同一说"。我国的有关案例和司法解释也采用了"方法限定说"。Product-by-process claim is a special product claim. In the course of examination, the United States, Japan, and China adopted ＂the same product＂ rule to determine the scope. However, in the course of infringement determination, the United States adopted the ＂the same process＂ rule and Japan adopted ＂the same product＂ rule.
