摘 要:确定社区矫正中央立法与地方立法的权限范围,必须深入社区矫正制度内部,解析构成这一制度的相关要素和具体事项。从法制、国家治理体系现代化、公私权划分三个维度进行央地分属识别,社区矫正的立法权限,既有适用法律保留原则而专属中央的立法权,也有中央立法为地方立法预留足够空间的央地立法分工与协作,更有根据地方具体情况和实际需要而专属地方的立法权。立法机关应当循着这三个维度,在不与上位法相抵触的前提下,具体确定社区矫正地方立法的执行性事项、地方性事项和先行性事项。It is necessary to have the deep leaning of the community correction system so that legislative department can define the scope and boundary of national and local legislation. In addition, the analysis of the elements and some specific subjects of this system need to be done. According to the law, the modern system of national governance and the division of private and public, the scope of different legislation of community correction can be identified. For the legis- lation of community correction, some of them belongs to the central government due to Vorbehah des Gesetzes. Some of them belongs to the local government because of the permission from the central government. Even some local authorities are given special legislation power according to the specific circumstances. Following these three paths, legislative department should figure out the issue, for example the enforcement issue, the local issue and the prerequisite issue.
