农地产权“三权分置”制度之完善——以农地经营权流转为视角

摘　　要：农地产权三权分置使农地产权结构得到进一步丰富和细分,也满足了流转土地经营权、保留土地承包权、坚持土地集体所有权的社会需要,但农村土地产权三权分置制度在理论、法律、政策、路径、操作、经济风险层面仍面临诸多问题。要完善农地产权三权分置制度,就必须明确界定经营权与承包权权能,在法律完善上进行适当探索,对土地征收与农业补贴等政策进行调整,鼓励以合作社形式实现农地抵押,建立农地经营权流转的风险防范机制。The division of agricultural land property rights between the three powers further enriched and subdivided the structure of agricultural land property rights,and also met the social needs of transferring the right to land management,retaining the right to land contract,and adhering to the collective ownership of land.However,the separation system of rural land property rights still faces many problems in law,policy,operation and economic risk.In order to improve the system of separation of agricultural land rights,we must clearly define the right to operate and the right to contract,properly explore the improvement of laws,adjust policies such as land acquisition and agricultural subsidies,and encourage the use of cooperatives as forms of agricultural land mortgage.We will establish a risk prevention mechanism for the transfer of the right to management of agricultural land.
