摘　　要：软件产业涵盖的产业类型宽泛,适用的知识产权类型包括著作权、专利权、商标、商业秘密和集成电路布图设计专用权,软件贸易中的知识产权场景和问题也因交易标的的不同而表现各异。随着技术发展,行业自主创新需求压力日益迫切,软件行业发展演变带来的知识产权场景变化,软件行业不断分层带来的知识产权关注诉求分化,对知识产权的保护和运用需求也越发迫切。因此,需要不断加强软件行业知识产权保护的范围和力度,有针对性的对待软件贸易中的知识产权问题,通过促进行业专利标准化逐步制定行业规则,协调产业引导政策以鼓励软件行业发展知识产权实力,从而不断提升我国软件产业在软件贸易中的竞争力。The software industry covers a wide range of industries.The applicable types of intellectual property rights include copyright,patent,trademark,trade secret and the exclusive right to design integrated circuit layout.The scene and problems of intellectual property in the software trade are also different because of the differences in the trade mark.With the development of technology,the demand pressure of independent innovation in industry is becoming more and more urgent,the intellectual property scene brought about by the development and evolution of software industry is changing,the demand for intellectual property rights caused by the continuous stratification of the software industry is dividing,and the demand for protection and application of intellectual property is becoming more and more urgent.Therefore,we need to strengthen the scope and strength of intellectual property protection in the software industry,treat the problem of intellectual property in the software trade,develop the industrial rules gradually by promoting the standardization of industry patent,coordinate the industry guidance policy to encourage the software industry to develop the intellectual property right,thus continuously improve competitiveness of our country’s software industry in the software trade.
