摘 要:"一带一路"贸易便利化涉及的国家、地区、贸易商以及事项众多,各个相关主体都有自己的利益考量,各相关主体在贸易便利化过程中产生争端不可避免,但是现有的争端解决机制不适应"一带一路"贸易便利化争端解决的需要,亟需完善。建立健全"一带一路"贸易便利化争端解决机制,应秉持共商共建共享和公平正义的理念,选择合理的模式,还应从强化争端解决机制的适应性、强化争端解决机制的衔接和争端解决结果一致性的保障、强化争端解决裁判的执行、建立争端解决援助制度等方面完善具体制度。There are lot of countries, regions, traders and matters about trade facilitation in the Belt and Road. Each relevant body has its own self-interest.It is inevitable that relevant parties have disputes in the process of trade facilitation. The existing dispute settlement mechanism will not be sufficient to dispute settlement about trade facilitation in the Belt and Road. For establishing and improving dispute settlement mechanism about trade facilitation in the Belt and Road, we should uphold the concept of joint development, sharing through consultation and equity and justice,choose the reasonable modes, also improve specific systems, such as strengthening the adaptability and coordination of dispute settlement mechanisms, strengthening safeguards for the consistency of the results of dispute settlement, strengthening the execution of the referee, establishing a dispute settlement assistance system.
