城镇化进程中的社区治理转型及其法治保障——以渝北M镇公租房社区为个案

摘　　要：以渝北M镇公租房社区的经验为个案,探究城镇化进程中社区治理的转型机制,提出新时期下社区治理转型的法治保障构想。中国城镇化进程的深入,既蕴含有继续深入发展的机遇,也隐藏着许多前所未有的治理风险和挑战。M镇公租房社区的经验显示,当前社区治理主要面临治理资源匮乏、社会结构转型和治理体制滞后的挑战。为了缓解治理困境,社区治理转型主要从发展网络治理、协同治理和合作共治三方面展开。在此基础上,建构社区治理转型的法治保障,实现其法治化,还需要依靠法治思维转换治理思路,通过依法行政推动整体治理,结合法治教育改善治理基础。Based on the field survey of M Town Public Rental Housing Community in Yubei District,this paper explores the transformation mechanism of community governance in the process of urbanization and proposes the concept of legal guarantee of community governance transformation in the new era.With the deepening of China＇s urbanization process,it contains both opportunities for continued in-depth development and many unprecedented governance risks and challenges.It was found that,at present,community governance is mainly confronted with the challenges of lack of governance resources,transformation of social structure and hysteresis of governance system.In order to ease the governance dilemma,the transformation of community governance mainly starts from three aspects,which are the development of network governance,collaborative governance and cooperative governance.In addition to these,to construct a legal guarantee mechanism that adapts to the transformation of community governance and to realize its rule of law also requires transforming the thinking concept of governance guided by law,promoting holistic governance through legal administration,and strengthen the legal education to improve the governance foundation.
