浅谈武警部队遂行反恐任务中职权运用与人权保障之平衡

摘　　要：基于恐怖主义给社会带来的负面影响,我国加大了对恐怖主义势力的打击力度。依据《中华人民共和国反恐怖主义法》,中国人民武装警察部队在国家反恐怖主义领导机构的部署下依法行使武警职权,参与恐怖活动的防范和处置行动。在实践中,武警职权的运用为武警部队圆满完成反恐任务提供了有力支持,但是也易引发与人权保障之间的冲突。如何有效平衡二者之间的冲突,是应当予以关注的问题。China has upgraded striking on terrorism because of its negative social influence.In accordance with Anti-Terrorism Law of the People＇s Republic of China,under the leadership of national anti-terrorism leading institutions,Chinese People＇s Armed Police Force exercises authority according to the law,and takes part in guarding against or dealing with terrorist activities.In practice,exercising of authority enables the armed police to complete their mission but meanwhile may easily lead to clash with human rights protection.It is necessary to focus on the issue of how to keep balance between them.
