摘　　要：在我国在线调解机制实效化过程中,理清在线调解机制的运行概况是基础,剖析在线调解理论的实效化困境是关键,破解在线调解理论实效化困境是保障。对此,应当首先明确在线调解的概念,探究其基本类型与运作模式。当前在线调解机制实效化面临规则体系不健全和在线调解协议执行困难两大困境。在破解之策上,首先应当健全在线调解机制的规则体系,通过司法解释的方式明确规范在线调解机制运行的关键程序规则,同时加快在线调解平台的建设,包括传统调解主体在线化和建设互联网专门化在线调解平台,并对在线调解协议的司法确认程序予以在线化和规范化。In the actualization of online mediation mechanism in China, making clear the general situation of the online mediation mechanism is the foundation, analyzing the difficulties facing the online mediation theory is the key, and overcoming the difficulties facing the actualization of the online mediation theory is the guarantee. In this regard, the first thing should be done is make clear the concept of online mediation and explore the basic type it belongs to and the mode of operation. Currently, the incompletion of system and the difficulty of the online mediation agreement execution are the main difficulties facing the actualization of the online mediation mechanism.To overcome the difficulties facing the actualization of the online mediation mechanism currently, the rule system of the online mediation mechanism should be established to clear and standardize the key procedural rules on which the online mediation mechanism operates, the construction of the online mediation complatform speeded up, which includes the online operation of the traditional mediation mainbody and the construction of the specialized online mediation platform, and the judicial conformation procedure of the online mediation agreement fulfilled online and in a standardized way.
