摘 要:预防和救济受损的生态、环境,保障公众良好环境权益的福祉是生态损害赔偿资金管理的重要使命。而环境公益诉讼的赔偿资金现有实践存在管理主体混乱、管理程序不完善等问题,不利于实现环境公益诉讼的公益目标。对生态损害赔偿资金的管理采用信托模式,构建以环保机关为委托人、以不特定的社会公众为受益人、以专业机构为受托人、以维护环境公益为目的之生态损害赔偿资金信托模式,不仅可充分利用信托制度的独特优势,弥补管理主体与运营主体重合的程序瑕疵,更与生态损害赔偿资金的形成法理相契合,从而能有效实现维护环境公益之目的。To protect the environment and to safeguard environmental rights of the public are serious purposes of managing compensation for environmental damages. Meanwhile,a lack of explicitness of managing subjects and defects of the managing procedures exist in the legal action of environmental compensation. And all of them can handicap the public interests of environmental lawsuits. Under the circumstances,we should take methods of adopting trust model to manage environmental compensation,for instance, environmental protection organs as settlor, random people as beneficiaries, specialized institutions as trustees and forming environmental compensation trust for the purposes of environmental protection. In this way,not only can we take advantages of the trust system to solve problems of overlapping powers between different sectors of the government,but also we can conform to the legal principles of environmental damages compensation,thus achieving the purposes of protecting environmental public interests.
