摘　　要：美国土地征收补偿制度是国家或者地方政府为了公共利益的需要,强制性地把私有土地收归国家所有并给予一定补偿的制度。这种违反合同自愿原则的强买行为之所以具有正当性,原因在于不仅基于"公共利益"的需要,更是因为给予了公正的补偿。The system of compensation for eminent domain in the United States,for the public interest,requires the state or government to obligate the private land to be owned by the state and based on a certain amount of compensation. The reason is justified that such a strong buy-in to violate the voluntary principle of contract is justified,not only because of the need of the ＂ public interest＂,but also because the fair compensation that it gives.
