关于《机动车交通事故责任强制保险条例》第二十二条文义的理解与反思  

About the Understanding and Reflection on the 22^(nd) Item in Regulations of Compulsory Insurance for Traffic Accident of Motor-driven Vehicle

摘　　要：本文针对长期以来在司法实践中对《机动车交通事故责任强制保险条例》第二十二条的理解与适用存在争议的问题,首先通过对比分析具有代表性的三种解释,从对条款文义通常解释视角出发,给出合理的解释建议;其次,分析了醉驾等事故情形中受害人所面临的风险特征,指出第二十二条将醉驾等事故情形纳入交强险免责范围的不合理之处;最后,从交强险"保护受害人权益"的立法精神视角出发,提出了修正第二十二条的相关建议。Aiming at the disputes that exist in the understanding and application of 22nd Item in Regulations of Compulsory Insurance for Traffic Accident of Motor - driven Fehicle during its long - term judicial practice, this paper first analyzes thine representative explanations through comparison and gives reasonable explanatory advice merely from the perspective of general interpretation of this item＇ s literary content. Then, this paper gives an analysis of the risk characteristics facing victims in drunk driving accidents, pointing out the unreasonable aspects of the 22nd I- tem that incorpoorates drunk driving accidents, etc. into Compulsory Insurance for Traffic Accident of Motor - driven Vehicle, exempt from responsibility. Lastly, this paper puts forward relevant suggestions about revising the 22nd I- tem from the angle of legislative spirit of ＂protecting victims＇ rights and interests＂ embodied in Compulsory Insurance for Traffic Accident of Motor - driven Vehicle
