检务保障工作与行政管理经费管理研究——以G省检察机关为例

摘　　要：本文在司法体制改革语境下,全面审视回顾检察机关检务保障的特点、规律,以G省检务保障为研究样本的实证研究中,系统分析了分级负责、分类负担的保障模式及运行机制,指出传统保障观念、滞后的保障体制和机制严重制约了检务保障工作,检务保障资源分配经常与实际需求脱节,不能适应检务发展的新需要,通过探究G省检务保障工作现状的主客观成因,同时借鉴国外的通行做法和我国的历史经验,突出检务保障研究的理论性、实务性、推广性,建议建立检察经费独立预算、由国家公共财政均等、统一保障体制,法定稳定科学的检察经费供给增长机制,以科学管理为目标的内部监督机制,与检务保障改革相适应的队伍保障机制,以期能够为司法改革中检务保障环节的改革提出具有法律政策推行依据、能够满足检察机关全面发挥法律监督职能、对社会公众关注有正面回应的体制机制方面的有益改革路径。In the context of reform of the judicial system,this article takes the comprehensive review of the characteristics of procuratorial organs procuratorial security and rule.Taking the province of G procuratorial work security as the research sample of empirical research,system analysis of the hierarchical responsibility,classification of the burden of security model and operation mechanism,points out that the traditional backward ideas,the guarantee of system and mechanism,severely restricted the procuratorial work security work,procuratorial work security resource allocation often disconnect the actual demand,cannot adapt to new procuratorial work need to develop. Through exploring the subjective and objective factors of G province procuratorial work security work,and drawing lessons from foreign experience in practice,and history of China,to show the theoretical,focusing and popularization of procuratorial work security research,we proposed the procuratorial independent budget funds system,which equalled by national public finance,unified security system;stable legal science procuratorial money supply growth mechanism;internal supervision mechanism with scientific management as the goal;team guarantee mechanism adapted to procuratorial work security reform,in order to put forward the basis with legal policy proposals which be able to ensure security of inspection;in full play in the foundation,can satisfy the procuratorial organs legal supervision function,a concern for the social public have a positive response of system and mechanism of beneficial path of reform.
