以“未备案公章”盖章的投标文件是否有效?——以某公路工程施工招标为例

摘　　要：投标人编制投标文件时,均须在投标文件上加盖单位公章。有的单位同时具备几枚公章,其中一枚已按照国家相关规定予以备案,其他公章未备案,或者所有公章均未备案。在投标人使用未备案的公章加盖在投标文件上时,因使用情形的不同,结果也不同。但无论如何,刻制和使用未备案公章,均须承担相应的行政责任。投标人应依法慎用公章。When preparing bidding documents, bidders are required to build official seal of the unit in the bid documents some units have a combination of several official seal, one is in accordance with the relevant provisions of the state for the record, no other official seal for the record, or has not been all official seal for the record in use for the record of official seal affixed with bidders in bidding documents, due to the difference of use case, the result is also different, but in any case, the seal and use registration seal, must undertake corresponding administrative responsibility, and the bidder should be used with care in accordance with the official seal.
