指定居所监视居住制度的整体性检视——兼论指定居所监视居住与监察留置之关系  

An Overall Inspection of Residential Surveillance at Designated Residence——and the Relationship between Residential Surveillance at Designated Residence and Detention of Supervision

摘　　要：指定居所监视居住并非新的刑事强制措施、准羁押措施,而应属于羁押的替代性措施。在功能上,指定居所监视居住除具有羁押替代、诉讼保障、人权保障以及诉讼效益之功能外,亦有降低法外措施适用率与刑事侦查取证等价值。较之于指定居所监视居住,监察留置的羁押替代、人权保障功能较弱,而诉讼保障、诉讼效益功能明显强于后者。适用内容方面,监察留置存有概括性强和部分规定阙如之局限,规范性明显弱于指定居所监视居住的相关规定。故而,指定居所监视居住制度可从制度功能、适用内容以及权利保障等方面对监察留置的构建提供规则启示。The residential surveillance at designated residence is not a new criminal compulsion measure and near custodial measure, but an alternative measure for custody. In terms of function, it is a substitution of custody, protection about litigation, protection about human rights and efficiency of litigation. Besides, the residential surveillance at designated residence has the value of reducing the application rate of extrajudicial measures and evidence collection in criminal investigation. Compared with the residential surveillance at designated residence, the function of detention of supervision about the substitution of custody and the protection of human rights are weak, and the litigation guarantee and litigation benefits are significantly stronger than the latter. With regard to the content, the regulation of detention of supervision is quite general and some content has not been stipulated. Thus, its normative nature is obviously weaker than residential surveillance at designated residence.Therefore, we should take into account the mature experience of residential surveillance at designated residence, and improve the detention of supervision from such aspects as adjusting the function of the system, detailing the content of application and strengthening the protection of rights.
