农村土地经营权物权塑造的逻辑与实现路径

摘　　要：农村土地经营权是激活与促进农地适度规模经营的能动因素,其性质的界定已经成为影响农地流转与农地抵押效益的关键环节。从我国农地产权的演变历史、物权理论、我国农地立法实践和从农地集中经营的效益逻辑来看,农村土地经营权均有物权化的必要。将附着在农村土地承包经营权上的社会保障功能剥离到土地承包权上,农村土地经营权塑造成无社会性功能限制的纯粹用益物权,更有利于农用地的市场流转,这是激活与促进农地规模经营的制度保障。农村土地经营权物权化有利于化解农地入股与农地抵押的制度困境,同时建议法律应该作出回应,明确规定土地经营权内容及其转让条件。bLand Management Right is an active factor in activating and promoting the scale management of farmland,and the definition of its nature has become the key link that affects agricultural land circulation and the agricultural land mortgage benefit.No matter from the evolution history of China farmland property right,or from the perspective of the logic of property rights theories,or from the analysis of farmland legislation in China,or from the logic of centralized management benefit,land management right should be necessary for real right.If the social security function can be separated from land contractual management right and be added to land contract right,land management right will become a pure usufructuary right without social function limits.This will be more conducive to farmland market circulation,the system guarantee for the activation and promotion of farmland scale operation.Land management right in rem is conducive to resolving land investment and farmland mortgage system,to which the law should respond.The conservative way is to pass administration regulation by the State Council,and the radical approach is to modify the ＂Land Management Law＂,＂Rural land Contract Law＂and ＂Property Law＂to define the content of the land management right transfer and its conditions.
