摘 要:在中国,"正当法律程序"(due process of law)已经不再只是司法领域的概念,它已经运用于行政、立法领域,并形成正当行政立法程序等正当法律程序形式。正当行政立法程序不是一项具体的法律制度,也不是"正当"和"行政立法程序"两个词汇的简单拼凑,而是一种由行政立法的动议制度、公开制度、听证制度和评估制度等一系列程序制度组成的集合体。这些制度是构造正当行政立法程序制度的起点、关键、中轴和保障。正当行政立法程序制度的构造,还要求公众具有良好的参与意识。In china, "due process of law", which is no longer just a concept of the jurisdiction, has been used in the administrative and the legislative, and developed other forms such as due process of administrative legislation. Due process of administrative legislation is not a specific legal system, neither is simply put together with words of "due" and "administrative legislation procedure". It is made up of a series of administrative legislation procedural system of proposing, publicity, hearing and evaluating, which underline the premise, key, axis, ensuring of the institutional configuration for due process of administrative legislation. In addition, the institutional configuration for due process of administrative legislation must base on the public good sense of participation.
