摘　　要：针对当前我国孤儿作品问题研究难以适应信息经济快速发展的现状,提出采用信息经济学视角重新审视孤儿作品问题。基于信息经济学研究孤儿作品问题,发现其实质是由于著作权人与使用者之间信息不对称引起的著作权垄断问题。设计出四条孤儿作品问题解决路径,即预防孤儿作品著作权危机、制定孤儿作品使用制度、优化孤儿作品著作权管理、促进孤儿作品增值开发。The present study of orphan works in China is difficult to meet the needs of the rapid development of information economy. The paper analyzes the present situation and reviews the problem of orphan works from the perspective of information economics. In the perspective of information economics,the problem of orphan works is the copyright monopoly caused by the information asymmetry between the copyright owner and user. The paper designs four solutions to the problem of orphan works,such as preventing the copyright crisis of orphan works,formulating the use system of orphan works,optimizing the copyright management of orphan works and promoting the value-added development of orphan works.
