诬告行为的释因逻辑及其治理路径研究

摘　　要：诬告行为是以匿名举报为主要形式,捏造虚假事实,意图让被诬告者遭受违纪处分甚至刑事追究的行为,与因情况了解不全面或认识偏差而导致的错告、检举失实行为有本质区别。诬告行为可能对被诬告者的生活和精神造成一定的损害,同时也浪费公共资源,扰乱党政机关正常工作秩序。诬告行为的产生是监督权利的异化,在一定程度上也反映出党内政治生态的不平衡。研究发现,诬告者可能因外界刺激引发自身内心的不满,借助于尚不完善的制度体系,实施诬告这一恶化政治生态的行为。完善举报制度,正确行使监督权利,提倡实名举报是减少诬告行为的有效对策;建立澄清保护机制,健全责任追究制度是维护被诬告者的重要举措。False accusation means that someone fabricated false facts through anonymous reports in order to make the accused subjected to punishment of discipline violation or criminal investigation. False accusation not only does harm to the accused＇s life and mentality,but also misleads anti-corruption and wastes the administrative resources. The occurrence of false accusation also reflects the imbalance of political ecology in the party to a certain extent,which can be said to be a kind of disguised corruption.The grievances due to external stimuli make the false accuser take advantage of the imperfect system and deteriorate the political ecology. The effective countermeasure to reduce the false accusation is to improve the reporting system and promote reporting in real names. The countermeasure to maintain the reputation of the falsely accused is to establish a mechanism for fault tolerance and improv the system of accountability.
