摘　　要：汉字字库单字作为中国互联网发展基础,其规制思路和法律规制态度对互联网+产业的发展至关重要。然单字问题直至今日尚无定论,保护与不保护各执一词,如何规制更是百家争鸣。无法得出确切结论的情况下,对于著作权法如何进行回应,应站在利益平衡的角度进行分析。通过微观辩证地分析著作权人与使用者间的利益,宏观分析社会经济发展的利益需求。用利益平衡原则指导调整利益关系,得出确认现有利益、宣告非法利益和克减部分合法利益的总体规制思路,强调要明确版权化规制态度。并据此思路提出保护为主、个案正义为辅的审判思维、合同法规避风险、建立字库著作权集体管理组织等举措进一步丰富汉字字库单字的规制方法,多位一体地解决规制困境。Chinese character fonts is the foundation for the development of internet in China so that the measures and attitude to regulate it is of crucial significance in the development of ＂Internet ＋＂industry. However,whether to protect it or not is still on issue today and there＇re different voices on howto regulate it. Without a final conclusion,howto respond to the Copyright Lawshould be analyzed from the perspective of the balance of interests through a micro-dialectical analysis of the interests of copyright owners and users and a macroscopic analysis of the interests of social and economic development. The principle of balancing interests can be employed to guide the adjustment of interest relations so as to make the general regulating measures to confirm the existing interests,proclaim theillegal interests and deduct some of the legitimate interests. And the attitude towards copyright regulation should be clarified. Based on this,the paper puts forward the measures like the trial-based protection supplemented by the case justice,the risk avoidance in the contract lawand the collective management organization of the fonts copyright,so as to further enrich the regulations of the Chinese character fonts and to solve the regulatory dilemmas comprehensively.
